Terms and Conditions of Sale for Consumer Customers
11/2024
The agreement includes the sale of electrical energy. Electricity transmission is the responsibility of the local distribution system operator. The electricity sales agreement is subject to Hehku Energia’s sales terms and conditions, the electricity sales terms and conditions recommended by Finnish Energy Industries (SME2024 for electricity contracts concluded on or after 21 November 2024; in other cases SME2014 according to the schedule communicated to the customer), and the applicable Electricity Market Act.
Validity of the Agreement
The electricity sales agreement shall enter into force on the terms stated in this confirmation unless you cancel the agreement you have concluded within two (2) weeks of placing the order, or raise an objection to the contents of the contract confirmation within three (3) weeks of it being sent. The cancellation form is available on Hehku Energia’s website via this link. The agreement may also be cancelled by email or by phone. After the fixed term ends, a fixed-term agreement shall continue as an agreement valid until further notice. The notice period for an agreement valid until further notice is two (2) weeks. If a fixed-term agreement is terminated while the fixed term is still in force, the customer will be charged a contractual penalty in accordance with the public service price list.
Billing
Electricity will be invoiced in accordance with the pricing information set out in the agreement. Any other charges shall be applied in accordance with the public service price list.
Electricity will be invoiced during the selected billing period. If metered consumption data is not available at the time of billing, consumption will be estimated. The estimate shall be based on the monthly percentage share of the annual consumption estimate for the metering point provided by the local distribution system operator. Estimated billing will be balanced against actual consumption based on meter readings. If invoices are issued once a month, the due date is the 15th day of the month, i.e. mid-month. If invoices are issued every two or three months, the due date is the 15th day of the first month.
Exceptional Situations
If the agreement cannot commence on the date stated in the agreement for technical reasons, we reserve the right to commence the agreement as soon as possible thereafter.
If confirmed price information for a variable-price product is not available at the time of billing, the price will be estimated. Depending on the product type, the estimate shall be based on the product’s most recently confirmed price information or on Nasdaq Commodities electricity futures prices. The estimated price will be balanced once the actual price information has been confirmed.
Late payment interest shall be charged in accordance with the Interest Act. For payment reminders, we charge in accordance with our public service price list.
Other Terms
The impact of changes in taxes, public charges and other comparable charges on the prices of the services included in the agreement shall be taken into account immediately from the date such changes enter into force. The electricity seller shall inform the customer of the impact of such changes on pricing as soon as possible after becoming aware of them.
The Seller has the right to amend the terms and conditions and prices of an electricity sales agreement valid until further notice. The Seller must send the user a notice stating how and from what date the prices or other contract terms will change. The Seller may adjust the price elements and contract terms of an agreement valid until further notice by giving one month’s prior notice on the website hehkuenergia.fi or through the Oma Hehku service.
The energy consumer checklist referred to in Article 3(16) of the Electricity Market Directive is available on the Energy Authority’s website.
Notifications concerning electricity distribution interruptions, meter readings, or other matters related to network services must be made to the local distribution system operator. Any complaints should primarily be addressed to [email protected] and secondarily to the Consumer Disputes Board.
