Terms of Use for Electronic Services

1. General Terms

These Terms of Use apply to the electronic services provided by Hehku Energia Oy (hereinafter “Hehku Energia”, Business ID: 2304509-2), such as the website, the Oma Hehku customer portal, and other digital services and materials, unless otherwise separately stated or agreed. By using the electronic services, you agree to comply with these terms.

2. Use of Electronic Services

The electronic services are intended for Hehku Energia’s customers and other users. The electronic services may only be used for approved and lawful purposes. Use of the electronic services for commercial purposes or for the benefit of third parties without Hehku Energia’s permission is prohibited. Use of the electronic services requires the user to have the necessary data connections, an internet browser, or a mobile application.

3. User Responsibilities

The user undertakes to:

- Provide accurate and up-to-date information when registering for or starting to use the electronic service.
- Ensure that the electronic service is not used for illegal, harmful, or third-party infringing activities.
- Keep any login credentials confidential, and immediately change the password in the electronic service or notify Hehku Energia without delay if the user suspects that their account has been subject to unauthorized use.
- Be responsible for any use made with their login credentials and for any resulting damages and costs.

4. Access Rights of a Representative Authorized by the Customer

The customer may authorize another person or company to use the electronic services in accordance with these Terms of Use, provided that the authorized party accepts and agrees to comply with the terms. Upon termination of the authorization, the customer or the authorized party must notify Hehku Energia’s customer service without delay or revoke the authorization themselves.

5. Company Rights and Responsibilities

Hehku Energia aims to provide the electronic services with the highest possible level of availability, but does not guarantee uninterrupted or error-free operation of the services. Possible service interruptions will be communicated where possible, and errors will be corrected within a reasonable time. Hehku Energia may modify, restrict, or suspend the provision of the electronic services in whole or in part without prior notice.

6. Intellectual Property Rights

All copyrights, trademarks, and other intellectual property rights related to the electronic services belong to Hehku Energia or its partners. The content of the electronic services may not be copied, distributed, or modified without Hehku Energia’s written permission.

7. Processing of Personal Data

Personal data is processed in accordance with Hehku Energia’s privacy policy and applicable data protection legislation. By using the electronic services, you accept the processing of personal data as described in the privacy policy.

8. Changes to the Terms

Hehku Energia may amend these terms. The changes will enter into force when published on Hehku Energia’s website. By continuing to use the services after such changes, you accept the updated terms.

9. Termination of the Agreement

Hehku Energia may close a user account or block access to the electronic service if the user breaches these terms or acts unlawfully. The user may stop using the services at any time.

10. Applicable Law and Dispute Resolution

These terms shall be governed by the laws of Finland. Any disputes shall primarily be resolved through negotiation. If no agreement is reached, disputes shall be settled in the court of the place of domicile of Hehku Energia.
